Why there are rules

Sites built with us are published online on our infrastructure. That is why there is a limit to what may be published. This page is part of our Terms of use. The list here is examples, and it is not exhaustive.

What's not allowed

Crime and harm to minors

  • Any content or activity that is an offence under the law.
  • Sexual content involving minors. We will remove it immediately, without notice, and also report it to the authorities.
  • Incitement to terror or violence, and support for a terrorist organisation.
  • Trafficking in drugs, weapons or people.

Fraud and deception

  • Fraud, phishing, or collecting card details and passwords by deception.
  • Impersonating another person, business, authority or brand.
  • Fake reviews or testimonials presented as genuine.
  • Misrepresenting a licence, certification or experience.
  • Misleading advertising, including misleading prices.
  • Pyramid schemes, investments with guaranteed returns and promises of profit.

Professions that require a licence

You may not offer a service that the law requires a licence for, without a licence. For example: medicine, legal advice, accounting, investment advice, pension advice and insurance.

Harming people

  • Defamation, harassment, threats or encouraging self-harm.
  • Incitement to racism or discrimination.
  • Publishing a person's personal information or image without their consent.
  • A deepfake of a real person, or a quote they didn't say, without their consent.

Other people's rights

  • Infringing copyright, trademarks or trade secrets.
  • Using images, fonts, music or video without a licence.
  • Removing rights notices or watermarks.

Security and infrastructure

  • Trying to break into the system, scan it or bypass protections or quotas.
  • Distributing malware, ransomware or spyware.
  • Using the site as a file server, download server or for video streaming.
  • Unusual load on the infrastructure, including bots and automated content scraping.

Email marketing and AI

  • Sending advertising without consent, contrary to the Communications Law.
  • Collecting addresses for email marketing through a site form without disclosure and consent.
  • Trying to bypass the AI's safety limits.
  • Using the service to train or develop a competing model.

The service itself

  • Reselling or renting the service to others, unless your plan allows it.
  • Copying or reverse engineering the platform.

What we do when there is a breach

Depending on how serious the breach is, we will choose one or more steps:

  1. A warning and a request to fix it, with reasonable time.
  2. Hiding or removing the content.
  3. Disabling a feature.
  4. Suspending the site.
  5. Closing the account.

For unlawful content, immediate danger, harm to minors, active fraud or at the demand of an authority, we will act immediately and without notice.

We do not scan customers' content in advance. We act when we receive a notice. Did we get it wrong? Write to support@uxellent.com and we will restore things.

How to report infringing content

Send a notice to abuse@uxellent.com.

In the notice, include:

  1. Full name, email and phone. If you are writing on behalf of the rights holder, give their name and your relationship to them.
  2. What was infringed: the work, mark or right, and if possible a link to the original.
  3. The exact address (URL) of the infringing page, and where on the page the content is.
  4. A statement that you believe in good faith that the use was made without permission.
  5. A statement that the details in the notice are correct.
  6. A signature, handwritten or electronic.

The same procedure applies to claims of defamation, invasion of privacy, publishing an image without consent, and impersonation. Instead of the details of the work, describe the harm and what it is based on.

What happens after you report

StepWhat happensWhen
1Confirming receipt of the notice.Within one business day
2Checking that the notice is complete. If something is missing, we will ask for it.Within 3 business days
3Passing the notice to the customer who published the content, unless there is a good reason not to.Within 3 business days
4Decision: remove, hide or leave.Within a reasonable time
5Updating the reporter on the decision. When carried out

In a clear case, in immediate danger, and for any sexual content involving minors, we will remove it immediately.

Counter-notice

A customer whose content was removed can send a counter-notice to abuse@uxellent.com, including: full details, which content was removed and where it was, an explanation of why the content does not infringe (for example a licence or consent), a statement that the details are correct, and a signature.

We will pass the counter-notice to the reporter. If within 14 days we don't receive a reply or notice of legal proceedings, we will consider restoring the content.

We are not a court and do not decide disputes over rights. Until a court decides, we will act so that the harm to both sides is as small as possible.

Repeat infringer

A customer against whom we received several well-founded notices will get a warning. If it continues, we will suspend or close the account. For a serious and deliberate breach, we will close the account the first time.

Misuse of the procedure

Anyone who knowingly sends a notice with false details may be liable for the harm caused to the customer. We may refuse to handle notices meant to harass.

We will handle a court order or a demand from a competent authority according to the law. Where allowed, we will notify the customer.

Reporting a security vulnerability

Found a security vulnerability? Write to support@uxellent.com with the word "Security" in the subject line, before you publish anything. Include the address, what you found and how to reach you.

We will not take action against anyone who reported in good faith, did not access other people's data beyond what was needed to show the problem, did not disrupt the service and gave us reasonable time to fix it.
